Terms and Conditions

Please read these Terms carefully before using the Website. They set out the rules for accessing the Website operated by DREAM SPORTS DIGITAL ENTERTAINMENT AG and the legal relationship between you and the Company.

01Definitions

In these Terms the following expressions have the meanings set out below:

"Company" means DREAM SPORTS DIGITAL ENTERTAINMENT AG, a company limited by shares (Aktiengesellschaft) incorporated in Switzerland, also referred to as "we", "us" or "our".

"Website" means the website available at dsp.game (and its former address dsplatform.io), including all its pages and sub-domains.

"Platform" means Dream Sports Platform, the video game and related services developed by the Company, including any demo, beta or pre-release version.

"Content" means all text, graphics, logos, images, video, audio, software, game footage and other material made available on or through the Website.

"User" means any person who accesses or uses the Website, also referred to as "you".

"Submission" means any information you send to us through the Website, including through the Contact form.

02Scope and acceptance

2.1These Terms and Conditions (the "Terms") govern your access to and use of the Website. They do not govern the purchase or use of the Platform itself, which is subject to the terms of the relevant distribution platform (for example, Steam) and any end-user licence agreement issued by the Company.

2.2By accessing or using the Website you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which forms part of these Terms. If you do not agree, you must not use the Website.

2.3If you use the Website on behalf of a football club, company or other organisation, you represent that you are authorised to accept these Terms on its behalf.

03Eligibility

3.1The Website is intended for users aged 16 and over. If you are under the age of majority in your country, you may use the Website only with the involvement and consent of a parent or legal guardian.

04Permitted use and conduct

4.1Subject to these Terms, we grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Website for your personal information and, where applicable, for evaluating a business relationship with the Company.

4.2You agree not to, and not to attempt to:

  • use the Website in breach of any applicable law or regulation;
  • access, probe or scan any part of the Website, its servers or networks without authorisation, or circumvent any security or authentication measures;
  • introduce viruses, malware or any other harmful code, or interfere with the proper functioning of the Website;
  • use robots, scrapers or other automated means to copy, extract or monitor Content, except as permitted by standard search engines;
  • reproduce, frame, mirror, sell, license or otherwise commercially exploit any part of the Website or Content;
  • impersonate any person or misrepresent your affiliation with any person or organisation, including any football club;
  • submit information that is false, misleading, defamatory, infringing or unlawful.

05The Platform and pre-release content

5.1The Platform is under active development. Screenshots, video, in-game footage, features, club environments, storylines and release information shown on the Website are illustrative, represent work in progress and may change, be delayed or be withdrawn without notice.

5.2Nothing on the Website constitutes a binding offer to sell or supply the Platform or any in-game item, nor a commitment to deliver any specific feature, partner club or release date.

5.3References to football clubs, competitions, players or brands are for identification and illustration only and do not imply endorsement, sponsorship or partnership unless expressly stated.

06Intellectual property

6.1The Website and all Content, including the Dream Sports Platform name, logos, trade dress, artwork, software and game footage, are owned by or licensed to the Company and are protected by copyright, trademark and other intellectual property laws.

6.2Football club names, crests, kits and other third-party marks are the property of their respective owners and are used, where applicable, under licence.

6.3Except for the limited right in clause 4.1, no rights are granted to you. You may not copy, modify, distribute, publicly display or create derivative works from any Content without our prior written consent.

07Submissions and feedback

7.1You are responsible for the accuracy of any Submission and confirm that you have the right to provide it. Personal data contained in Submissions is processed in accordance with our Privacy Policy.

7.2If you send us ideas, suggestions or feedback about the Platform or the Website, you agree that we may use them without restriction or compensation. Commercial proposals from clubs, sponsors, partners and investors remain subject to any separate agreement we may enter into with you.

7.3Information published on the Website about the Company, its business or its plans is not an offer of securities or investment advice. Any investment is subject to separate documentation and applicable law.

08Accounts

8.1Where the Website allows you to create an account, you must provide accurate information, keep your credentials confidential and notify us promptly at info@dsp.game of any unauthorised use. You are responsible for activity carried out through your account. We may suspend or close an account that breaches these Terms.

09Third-party services and links

9.1The Website contains links to and embeds from third-party services, including Steam, Medium, LinkedIn and Discord. These services are operated independently under their own terms and privacy policies. We have no control over and accept no responsibility for their content, availability or practices.

10Disclaimer

10.1To the fullest extent permitted by law, the Website and Content are provided "as is" and "as available". We make no representation or warranty, express or implied, that the Website will be uninterrupted, error-free, secure or free of harmful components, or that the Content is accurate, complete or up to date.

11Limitation of liability

11.1To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data, goodwill or business opportunity, arising out of or in connection with the Website or these Terms.

11.2Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or wilful misconduct.

12Indemnity

12.1You agree to indemnify the Company against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Website, to the extent permitted by applicable law.

13Suspension and changes to the Website

13.1We may modify, suspend or discontinue the Website or any part of it at any time, and may restrict your access if we reasonably believe you have breached these Terms.

14Changes to these Terms

14.1We may amend these Terms from time to time. The updated version will be published on this page with a new effective date. Material changes will be highlighted on the Website. Your continued use of the Website after the effective date constitutes acceptance of the amended Terms.

15Governing law and jurisdiction

15.1These Terms and any dispute arising out of or in connection with them are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

15.2The ordinary courts at the Company's registered seat in Switzerland have exclusive jurisdiction, subject to an appeal to the Swiss Federal Supreme Court. Mandatory rights of consumers to bring proceedings before the courts of their place of residence, and mandatory consumer-protection provisions of that place, remain unaffected.

16General provisions

16.1If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be replaced by a valid one that most closely reflects its original intent.

16.2Our failure to enforce any right does not constitute a waiver of that right. You may not assign your rights under these Terms without our prior written consent.

16.3These Terms are drafted in English. Any translation is provided for convenience only; the English version prevails.
